Buying a Leveraged Bitcoin ETF: What Is Behind the 3x Products
Cboe has filed six triple-leverage funds with the SEC, including one on Bitcoin and one on Ether. This piece explains why the leverage holds for a single trading day only, why the funds hold no coins, and which 3x products already trade on an exchange in Europe.

A leveraged Bitcoin ETF does not triple your gain over the holding period; it triples the move of a single trading day. That one distinction decides whether the product suits you, and it is written that literally in the documents now in question.
The occasion is a filing printed in the US Federal Register on August 19, 2026. The American exchange Cboe BZX wants to list six funds, each designed to deliver three times the daily performance of an underlying. Two of them concern crypto: a 3x Bitcoin ETF and a 3x Ether ETF. English-language coverage has reported the filing. What the reports leave out are the three points that matter when you buy: the funds hold no coins, the leverage is reset every evening, and nothing has been approved so far.

What a leveraged Bitcoin ETF is: the definition in one sentence
A leveraged Bitcoin ETF is an exchange-traded fund that aims for a fixed multiple of Bitcoin's daily return, usually double or triple, and sets that target anew every trading day.
Three terms sit inside it, and each carries its own meaning. ETF stands for exchange-traded fund, a fund whose shares trade like a stock on the exchange. Leverage means a price move in the underlying arrives amplified in the product, upward and downward alike. Daily return is the change from one market close to the next, a span of about 24 hours and none beyond it.
The word "daily" is no footnote in the fine print. It is the actual product feature. The Cboe filing carries the same sentence for each of the six funds: the fund seeks daily investment results, before fees and expenses, that correspond to three times the daily performance of its reference value.
Why "3x" only ever holds for one trading day: the daily reset
For a product to deliver exactly triple every day, it has to reset its position every day. This process is called the daily reset, or rebalancing: after the close, the exposure is adjusted so that it again equals exactly three times the current fund assets.
That sounds technical and has a very practical consequence. When the price rises, the product buys more, because the grown assets support a larger exposure. When the price falls, it has to cut back. A leveraged product therefore buys into strength and sells into weakness, mechanically, without any view on the market.
For you as a holder it means this: your return over a week or a month is the result of a chain of daily returns multiplied together. As a rule, that result does not equal three times the underlying's return over the same period. This property is called path dependence: what counts for your result is not only where the price ends up but the route it took to get there.
Path dependence: what two opposing trading days do to your stake
The quickest way to grasp it is a calculation with round numbers. The following is a worked example, not a market forecast; the percentages are chosen freely.
The case without direction
Bitcoin rises 10 percent on day one and falls 10 percent on day two. The underlying then stands at 1.10 × 0.90 = 0.99, so 1 percent below the start. The triple-leveraged product does plus 30 percent on day one and minus 30 percent on day two: 1.30 × 0.70 = 0.91. That is a 9 percent loss, where three times the underlying's loss would have been 3 percent.
The 6 percentage-point gap arises solely from the order of the moves. Nothing about it is a fault of the product; it is its mathematics.
The case with direction
If instead Bitcoin rises 10 percent on two consecutive days, the underlying reaches 1.10 × 1.10 = 1.21, so plus 21 percent. The leveraged product manages 1.30 × 1.30 = 1.69, so plus 69 percent. Three times 21 percent would have been 63 percent. In a clear trend, compounding works for you.
The two calculations together yield the rule of thumb that every prospectus repeats in its own words: leveraged products reward sustained direction and punish back-and-forth.
Volatility decay: why sideways phases eat the leverage
The effect from the first worked example is what the technical language calls volatility decay. It describes the systematic erosion of a leveraged product in choppy markets without a clear direction, and it grows with the square of the range of the swings.
In practice that means the choppier the market, the more expensive it becomes to hold over several days, even if the underlying ends up at the same level. Bitcoin and Ether are among the most volatile tradable assets there are, which is why the effect hits far harder here than with an equity index.
For the same reason, every issuer of such products carries the same notice ahead of it: these papers are meant for active traders with a short time horizon who watch their position. They are not built as a building block for a savings plan or a portfolio addition over years. The Cboe BZX Exchange submitted the filing to the US securities regulator, the SEC, on August 10, 2026. On August 19, 2026, the notice appeared in the Federal Register, listed under file number SR-CboeBZX-2026-065 and release number 34-106137. It seeks approval to list six funds launched as series of the VS Trust: one triple-leveraged product each on gold, silver, Bitcoin, Ether, light crude oil and natural gas.
The sponsor is Volatility Shares LLC, a commodity pool operator registered with the US futures regulator, the CFTC. The funds run as a commodity pool and are not registered as investment companies under the Investment Company Act of 1940. That is the same legal framework under which commodity futures funds already operate in the US.
One sentence in the filing itself is notable. The funds do not meet the standard of BZX Rule 14.11(e)(4)(F), and the exchange writes that out expressly: this rule prohibits leveraged products, and because each fund seeks three times the daily performance, it does not comply with the standard. The Cboe therefore seeks approval in full knowledge that its own rulebook stands against it. That is exactly what the SEC now has to decide. Filed does not mean approved: how the procedure runs to October 3, 2026
Some reports have already read the notice as an approval. That is not correct. What exists is the publication of a proposed rule change under Section 19(b)(1) of the US Securities Exchange Act, combined with a call for the public to comment on it.
Two dates you can keep in the calendar follow from the document:
- September 9, 2026: up to this day, the SEC accepts written comments on procedure SR-CboeBZX-2026-065. The text names the deadline verbatim.
- October 3, 2026: 45 days after publication, the Commission has to approve the filing, reject it, or open a formal review procedure. It can extend that deadline to up to 90 days, in which case the latest date falls on November 17, 2026.
A third point comes on top and is rarely mentioned: the trust's registration statement is not yet effective. Even after the SEC has agreed to the exchange rule, the shares may only be traded once this step, too, is complete. Between the filing and the first trading day there are therefore two separate procedures.

The proposed 3x Bitcoin ETF holds not a single Bitcoin
The point where most readers are surprised sits in the middle of the filing. The 3x Bitcoin ETF does not invest in physical Bitcoin. It tracks its reference value through futures contracts on Bitcoin traded on the Chicago Mercantile Exchange, supplemented by cash and cash-like investments.
A futures contract is a binding agreement to settle an underlying at a set date at a price agreed today. The buyer of a Bitcoin future thus holds a claim to a sum of money derived from the Bitcoin price, and no coins.
The difference is more than a formality. With a physically backed product, an actually held quantity of Bitcoin sits behind each share. With a futures-market product, what sits there is a contract with a counterparty and a margin deposit. Both can behave similarly as the price moves, and both do not always.

Roll period and futures curve: why the fund swaps its contracts monthly
Futures contracts expire. A fund that wants to stay permanently invested therefore has to swap expiring contracts regularly for later-dated ones. This process is called rolling.
The filing describes the procedure precisely. The reference value consists of futures contracts of the first and second delivery month. Six trading days before the nearest contract expires, a roll period of five trading days begins, on each of which roughly 20 percent of the expiring positions are moved into the next contract.
Whether that swap costs money or brings some in depends on the shape of the futures curve, that is, on the price difference between the delivery months. If the later contract sits above the earlier one, it is called contango, and rolling costs. If it sits below, it is called backwardation, and rolling brings something in. A futures-market product bears this effect on top of the management fee, and it appears in no fee disclosure.

The papers trade in euros and in US dollars. The issuer's product page states, for the long product on Bitcoin, an annual management fee of 2.00 percent and an additional unscheduled adjustment that kicks in as soon as the underlying moves 10 percent against the position within a single day. A listing on the Italian SeDeX followed in February 2026.

ETP or ETF: why the legal form decides your issuer risk
In Europe these papers are called ETP, exchange-traded product, and that is no marketing variant of the word ETF. An ETF is a segregated fund: the fund assets stay separate from the assets of the fund company and, in the event of its insolvency, do not fall into the estate.
An ETP in the form common in Europe, by contrast, is a debt security of the issuer, usually collateralised, but a claim nonetheless. If the issuer defaults, the quality and the custody of the collateral decide what is left of your stake. This difference is called issuer risk, and with a leveraged product it comes on top of market risk.
With unleveraged crypto ETPs, too, the construction decides. Two papers on the same underlying can be collateralised differently, held in custody differently and structured differently, without the name revealing it. The key information document names the construction on its first page, and that minute of reading time is well invested.
Why crypto CFDs carry a leverage cap of 2:1, but a 3x ETP does not
This is where many pause. With its general decree on contracts for difference of July 23, 2019, in force since August 1, 2019, Germany's BaFin set fixed leverage limits for retail clients. For cryptocurrencies, the limit stands at an initial margin of 50 percent of the notional value, that is, a leverage of 2:1. Added to that are a binding negative-balance protection and an automatic close-out as soon as the available funds fall below 50 percent of the required margin.
These rules apply to CFDs, contracts for difference, where you open a position on margin. A leveraged ETP is legally something else: a security you buy and pay for like a stock. There is no margin, no margin call, and hence no case for applying the leverage cap. Your maximum loss is the amount invested, but no more, and, importantly, no less than with a CFD at half the leverage.
Anyone who confuses the product categories therefore regularly underestimates how quickly a 3x paper can consume the stake. A daily loss of about 33 percent in the underlying would, on the arithmetic, take a triple-leveraged paper to zero, which is why issuers build in the unscheduled adjustments described above.
Tax and custody: what changes compared with buying Bitcoin directly
You buy an ETP through your securities account. Gains from selling securities are subject in Germany to the flat-rate withholding tax, which a domestic custodian withholds and remits. With the direct purchase of coins through a trading platform, by contrast, the rule for private disposals under Section 23 of the German Income Tax Act applies, with its familiar one-year period.
For physically backed crypto ETPs with a delivery claim, the tax classification has been disputed for years. With a leveraged paper on futures contracts, that question does not arise in this form, because there is no claim to delivery of coins. Take this paragraph as orientation and have your specific case checked for tax before you build a position. Who leveraged crypto products are meant for, and how you can tell
There is a robust test, and it needs no market view. Ask yourself how long you want to hold the position. If the answer is "one trading day or a few", the construction fits your plan. If it is "weeks" or "months", you are working against the daily reset.
Three details reveal a product's target group before you read the prospectus:
- If the investment objective contains the word "daily", the paper is a trading instrument with a one-day horizon.
- If the key information document names a recommended holding period of one day, the issuer is telling you so expressly.
- If the ongoing charge sits clearly above that of an unleveraged paper on the same underlying, you are paying for the mechanics too.
And one note that is easily missed: a short product with triple leverage is no hedging instrument for a long-term portfolio. Over longer periods it drifts away from the mirrored performance of the underlying for the same mathematical reasons as its long counterpart.
Leveraged Bitcoin ETF: what to take away
